摘要
本文从学理上辨析了数据机制与传统价格竞争机制的差异,并着重探究了更好发挥数据机制作用的基础制度体系。具体地,从数据确权、流通、交易、分配、安全5个方面依次阐述了它们对数据机制的理论作用、存在的现实问题以及亟需突破的制度瓶颈等内容。其中,确权是数据要素化的前提,流通是数据广泛使用的表征,交易或共享是数据交互使用的主要方式,分配是数据机制产生的社会结果,安全则是促使数据机制健康有序发挥作用的基本保障,进而论述了欧美建立和完善数据机制的经验做法。有关结论对我国构建数据基础制度体系和提高线上市场资源配置效率具有一定的政策启示。
In this paper, the differences between data mechanism and traditional price competition mechanism are analyzed from the theory perspective, and the basic institutional system for better playing the role of data mechanism is explored.Specifically, from the data right confirmation, circulation, transaction, distribution and security, this paper expounds the theoretical role of data mechanism, the existing practical problems and the institutional bottlenecks that need to be broken through.Among them, the confirmation of rights is the premise of data elements, circulation is the representation of the wide use of data,transaction or sharing is the main way of data interactive use, distribution is the social result of data mechanism, and security is the basic guarantee to promote the healthy and orderly functioning of data mechanism. Furthermore, this paper discusses the American and European experience in establishing and improving data mechanism. The conclusion has some policy implications for China’s construction of data infrastructure system and improvement of the online market resources allocation efficiency.
