摘要
长江是我国重要的生物基因宝库和生态安全屏障,对于建设美丽中国、实现中华民族伟大复兴具有战略性地位。但多年来的粗放型发展模式严重污染和破坏了长江流域的生态环境,而且在目前的治理实践中,各区域对于长江保护的政令措施不尽统一,亟须推进长江保护法治化,将长江保护工作纳入法治轨道。理论研究的重大突破、现行法律的有利条件、实践工作的经验积累和域外治理的成功范例,为长江保护法治化奠定了坚实的现实基础。未来推进长江保护法治化,应当坚持生态优先与绿色发展,设立层次分明的管理机构,重视生态环境的保护修复,明确污染破坏的法律责任,健全多元治理的制度体系。
The Yangtze River is an important biological gene treasure house and ecological security barrier in China. It has a strategic status for building a beautiful China and realizing the great rejuvenation of the Chinese nation. However, not only has the extensive development mode over the years seriously polluted and destroyed the ecological environment of the Yangtze River basin, but also in the current management practice, various regions have different policies and measures for the protection of the Yangtze River. It is urgent to promote the rule of law in the protection of the Yangtze River and bring the protection of the Yangtze River into the track of legalization.The major breakthroughs in theoretical research, the favorable conditions of the current laws, the accumulation of practical work experience and the successful examples of foreign governance have laid a solid realistic foundation for the legalization of the Yangtze River protection.To advance the legalization in the protection of the Yangtze River in the future, it is necessary to adhere to ecological priority and green development, set up hierarchical management agencies, attach importance to the protection and restoration of the ecological environment, clarify the legal responsibility for pollution damage,and improve the system of pluralistic governance.
