摘要
传统社会学理论对志愿服务概念的理解各有侧重,但都不能全面系统指导志愿服务事业的发展。当代中国社会治理理论、制度和实践的创新,为志愿服务及其法律机制的发展完善奠定了基础。现有的志愿服务相关立法,明确了志愿服务主体的法律属性和志愿服务的权责法律关系,为志愿服务法律机制的运行提供法律依据的同时,也留下了通过立法手段完善相关法律规定的空间。在现有立法条件下,志愿组织的规范化制度运作和相关部门的监管与指导构成的两轮驱动,则是在法律实践层面推动志愿服务法律机制良性运行的关键。
Traditional sociological theories have different emphasis concerning the concept of volunteer service,and none of them can comprehensively and systematically instruct its development.China’s innovation in theory,system and practice of social governance at the time has laid a foundation for the development and perfection of voluntary service and its legal mechanism.The existing legislation related to voluntary service has clarified the legal attribute of the subject of voluntary service and the legal relationship between its rights and responsibilities,which provides legal basis for the operation of its legal mechanism and also leaves room for improving the relevant legal provisions through legislative means.Under the existing legislative conditions,the double drive composed of the standardized system operation of voluntary organizations and the supervision and guidance of relevant departments is the key to promoting the healthy operation of the legal mechanism of voluntary service practice.
