摘要
档案个人信息是档案内容的重要组成部分,但随着档案的社会利用而面临着权益受损的风险。通过《档案法》转介条款的指引,档案个人信息的保护以个人信息保护相关立法为依据。但为了实现档案个人信息保护与利用的平衡,以及档案个人信息保护的精准化,还需要通过对档案个人信息的法益分层,形成档案个人信息的分类标准,并以此为基础选择不同的保护模式:首先是对承载隐私权法益的隐私性档案个人信息,采取个体赋权模式,通过权利化方式进行强化保护;其次是对承载一般个人信息法益的私人性档案个人信息,采取行为规制模式,规范利用行为过程以形成间接保护;最后是对承载超个人信息法益的社会性档案个人信息,采取数据开放模式,强调信息利用的同时予以最低限度保护。
Archival personal information is an important part of archives content,but with the social use of archives,it faces the risk of rights and interests damage.Through the guidelines of the switchover clauses of the Archives Law,the protection of archival personal information is based on legislation related to the protection of personal information.However,in order to achieve the balance between the protection and utilization ofarchival personal information,as well as the precision of archival personal information protection,it is necessary to form a classification standard for archival personal information through the stratification of legal interests of personal information in archives,and choose different protection modes based on this basis.First of all,adopt the individual empowerment model for the private archival personal information that bear the legal interests of privacy,and strengthen the protection by making it a right.Secondly,adopt a behavioral regulation model to standardize the use of behavioral processes to form indirect protection for the private archival personal information which bears the legal interests of general personal information.Finally,adopt the data opening mode and emphasize the use of information and give minimum protection at the same time for the social archival personal information which bears the legal benefits of superpersonal information.
