摘要
危险废物作为污染环境罪的规制对象,在区分罪与非罪、此罪与彼罪中占据重要地位,如何规范、准确认定危险废物,是司法实践中的难题。现行相关司法解释及司法解释性质文件所确立的危险废物司法认定规则,在实践运行中发挥着不可或缺的指导作用,同时囿于其列举式规定的开放性、与行政执法证据规则的脱节、严惩思维下法官先入为主的认定理念等因素,造成危险废物范畴属性界分模糊、证据名类不一、司法行政化风险等新的适用困境。为此,需要从解释论角度加强危险废物所属范畴的类型化建构,从行刑衔接角度构建统一的证明基准,从导向重塑角度修正危险废物的司法认定偏差。
As the object of regulation of environmental pollution crimes,hazardous wastes occupy an important position in distinguishing crimes from non-crimes and this crime from the other crime.The rules of judicial recognition of hazardous waste established by the current relevant judicial interpretations and documents of judicial interpretation play an indispensable guiding role in practice,but at the same time are limited by the openness of enumerated provisions,the disconnection with the rules of evidence for administrative enforcement,and the preconceived notion of judges under the strict punishment mindset,resulting in new application dilemmas such as blurred distinctions of the category of hazardous waste,varied names and classes of evidence,and the risk of judicial administrativeization.Therefore,it is necessary to strengthen the typological construction of the category of hazardous waste from an interpretive perspective,to construct a unified benchmark of proof from the perspective of the interface between administrative enforcement and criminal justice,and to correct the bias in the judicial recognition of hazardous waste from the perspective of reorientation.
