摘要
面对持续严峻的生态环境污染问题,刑法有必要深度参与到长江经济带的“大保护”中去。当前,在长江经济带生态环境协同保护机制中,刑法手段还存在行政依赖性强而独立性不足、行为类型归属的明确性不足、重点污染单位的打击力不足以及罚金刑资格刑的惩治力不足这四大方面的问题。为破解环境犯罪刑事司法功能虚置的难题,必须要加强公安机关打击环境污染犯罪的主导性。将污染环境罪按所侵害的具体法益分解,设立统分结合的罪名体系,可以提高刑法打击严重污染环境行为的准确性。重拳打击重点排污单位实施的对生态环境造成极其严重后果的污染行为,是当下平衡环境保护与经济发展矛盾的现实选择。提高罚金刑的金额,扩大职业禁止的适用范围,可以加大刑法对环境污染犯罪的惩治力度,同时兼顾生态环境的修复。
In the face of persistent and severe pollution of the ecological environment, it is necessary for the Criminal Law to participate deeply in the "big protection" of the Yangtze River Economic Belt. At present, in the coordinated protection mechanism of the ecological environment of the Yangtze River Economic Belt, the criminal law means still have strong administrative dependence and insufficient independence, lack of clarity in the attribution of behavior types, insufficient strike power of key polluting units, and insufficient punishment power for fines These four major issues. In order to solve the problem of the virtual judicial function of environmental crimes, it is necessary to strengthen the leading role of public security organs in combating environmental pollution crimes. Decomposing the crime of environmental pollution according to the specific legal interests infringed, and establishing a system of accusations of integration and division can improve the accuracy of the criminal law in combating serious environmental pollution. Fighting heavily against the pollution activities of the key pollutant discharge units that have extremely serious consequences on the ecological environment is a realistic choice to balance the contradiction between environmental protection and economic development. Increasing the amount of fines and expanding the scope of application of occupational prohibitions can increase the punishment of criminal law for environmental pollution crimes, while taking into account the restoration of the ecological environment.
