摘要
司法解释对行政协议所规定的主体和目的要件并非成立行政协议的充分条件,对行政协议判准的质疑能否成立,取决于内容要件即“行政法上权利义务”是否妥当。以行政机关的非市场行为作为辨别行政协议的标准,仍然指向行政法上权利义务,因此行政法上权利义务是判断行政协议的适当标准。行政法上权利义务可具体化为:协议权利义务之来源系秩序行政领域中对行政法规范之执行或对具体行政行为之替代;协议明确约定属于行政职责权限的权利义务;协议为相对人设定了公法权利义务;行政机关依法享有变更解除协议的优益权。国有自然资源或国有土地使用权出让合同为行政协议。
The subject and purpose elements stipulated in the judicial interpretation of administrative agreement are not sufficient conditions for an administrative agreement.Whether the doubt about the criteria of the administrative agreement is tenable or not depends on whether the content elements,namely“rights and obligations in administrative law”,are appropriate.Taking the non-market behavior of administrative organs as the standard to distinguish civil from administrative agreements still points to the rights and obligations in administrative law.Therefore,the rights and obligations in administrative law are the appropriate criteria to distinguish administrative agreements.The rights and obligations in administrative law can be embodied as follows:the source of agreement rights and obligations is the implementation of administrative law norms or the substitution of specific administrative acts in the field of order administration;The agreement clearly stipulates the rights and obligations that belong to the administrative duties or powers;The agreement sets rights and obligations in public law for counterpart;The administrative organ shall enjoy the preferential right to modify and terminate the agreement according to the law.The transfer contract of the right to use state-owned natural resources or state-owned land is an administrative agreement.
