摘要
农村集体产权制度改革试点工作已接近尾声,但农村集体经济组织运行过程当中所涉及的集体经济组织法人治理机制、成员资格认定、股权设置与管理模式等方面仍存在治理机制混乱、认定标准不一、股权分配不均等问题。对川渝两地四区市近200户农民以问卷调查、座谈访问等方式得出的统计结果表明,需要在了解集体经济组织运行实际状况的基础之上把握制度落地的关键,并进行针对性的制度设计与体系构建,首先,应加强完善集体经济组织治理与监管机制,分步处理“政经分离”问题;其次,需通过进一步明确成员资格认定标准并形成相应决议机制来保障成员的相关利益;最后,可鼓励集体经济组织根据自身情况不断丰富股权类型设置与权能实现形式,使集体收益分配落到实处。
The pilot work of rural collective property rights system reform is drawing to a close,but there are still some problems in the legal person governance mechanism,membership certification,equity setting and management mode,such as confusion of governance mechanism,different certification standards and uneven distribution of equity.The statistical results obtained by questionnaire survey and discussion visit to nearly 200 farmers in four districts and cities of Sichuan and Chongqing show that the key to system landing and targeted system design and system construction should be grasped on the basis of understanding the actual operation situation of collective economic organizations.First,we should strengthen and improve the governance and supervision mechanism of collective economic organizations,and deal with the problem of"separation of politics and economy"step by step.Secondly,it is necessary to further clarify the certification standards of membership and form the corresponding resolution mechanism to protect the related interests of members;Finally,collective economic organizations can be encouraged to continuously enrich the forms of equity type setting and power realization according to their own conditions,so that the distribution of collective income can be implemented.
