摘要
一定程度上,交警行政执法社会效应的展现依赖于自由裁量权的规范化行使。基于高效的信息采集、分析、处理技术多维度刻画违法行为调查取证资料,以数据化、规则化驱动行政处罚自由裁量权的信息化决策,可以消除执法的随意性和主观性。本文认为,完善自由裁量过程中评判标准的辅助量化决策机制,有助于为规范行使自由裁量权提供精细化的操作空间,提升公安机关交通管理部门综合执法效能。
To some extent,social effect of traffic police administrative law enforcement depends largely on the standardized execution of penalty discretion.The investigation and evidence collection of illegal acts are described from a multidimensional view based on the technology of efficient information collecting,analysis and processing.To drive the information-based decision-making of administrative penalty discretion with data and rules would eliminate the randomness and subjectivity of law enforcement.Improving the auxiliary quantitative decision mechanism for the judging criteria in the process of discretion would provide fine operability for standardized execution of penalty discretion and would improve the comprehensive law enforcement effectiveness of the traffic management department of public security organ.
