摘要
遗产管理人是现代各国继承法不可或缺的主体内容,我国民法典对遗产管理人的产生、指定、职责、未尽职责的民事责任和获得报酬权等内容作出了规定,但现有规定还存在遗产管理人任职资格不明确、程序缺失、欠缺遗产管理人的辞任和解任规定等不足,需要通过制定实施细则、立法解释、司法解释等途径健全遗产管理人任职资格法定条件、完善遗产管理人的权利外观、扩展遗产管理人的职责、建立遗产管理人监督机制、明确遗产清单制作主体、完善遗产债务清偿制度等,进一步完善我国遗产管理人制度。
The estate administrator is an indispensable subject in the inheritance laws of modern countries.Chinas Civil Code stipulates such issues as the establishment and designation of estate administrators,and their duties,civil liability for failure to perform the duties,and right to receive remuneration.There are still some deficiencies in this system such as unclear definition of the qualification for estate administrators,lack of proper procedures,and lack of regulations for the resignation and dismissal of estate administrators.In order to further improve Chinas estate administrator system,it is necessary to take a series of measures,including:to improve the legal conditions for the qualification of the estate administrator and the form of the estate administrators rights;to expand the responsibilities of the estate administrator;to establish a supervision mechanism for the estate administrator;to clearly define the subject who has the right and capacity to make the estate list;and to improve the estate debt repayment system,through formulating detailed implementation rules,legislative interpretations,and judicial interpretations.
