摘要
多年来,由于防水标准规范的导向性缺陷,防水工程的防水功能模糊不清,定位不明确,导致防水行业混乱与垄断相伴相生,资本野蛮无序扩张,利用防水标准规范和行政规定垄断防水市场,违背公平竞争原则,排除和限制公平竞争,损害消费者权益的现象愈演愈烈。国家反垄断法律法规的完善为防水标准规范和行政规定的垄断修改提供了法律保障。本文首次提出弥补防水标准规范的导向性缺陷和界定垄断的必要条件,规范防水工程践行防水价值,在防水价值基础上实现市场经营主体的经济效益,供反垄断审查修改参考。
Over the years,due to the guiding defects of waterproof standards and specifications,the waterproof function of waterproof engineering is ambiguous and the positioning is not clear,which leads to the chaos and monopoly of waterproof industry and the barbaric and disorderly expansion of capital.The phenomenon of monopolizing the waterproof market by using waterproof standards and administrative regulations,violating the principle of fair competition,excluding and restricting fair competition and damaging the rights and interests of consumers is becoming more and more intense.With the improvement of national anti-monopoly laws and regulations,it provides legal guarantee for the monopoly modification of waterproof standards and waterproof administrative regulations.This paper proposes for the first time to make up for the guiding defects of waterproof standards and specifications and define the necessary conditions for monopoly,standardize waterproof engineering to practice the value of waterproof,and realize the economic benefits of market operators on the basis of waterproof value,which can be used as a reference for antitrust review and modification.
