摘要
近年来,美国将中国视为战略竞争对手,极力打压中国高科技企业发展,其中最主要的措施就是出口管制。美方对中国实施出口管制过程中,最具影响力、最具代表性的案例就是严格对华为的出口管制措施,意图打压华为在全球通信行业,特别是5G技术方面的优势地位,对华为生产经营造成重大不利影响。本文以美国对华为加强出口管制措施案为例,剖析美国出口管制法律制度的起源、演变及趋势,评估其对中国的影响,以及中国应采取的对策。
In recent years,the US has regarded China as a strategic competitor and has made great efforts to suppress the development of Chinese high-tech enterprises,among which export control is the most important measure.The most influential and representative case is the US tightening of export control against Huawei,with an aim to suppress the Chinese company’s dominant position in the global telecommunications industry,especially in 5 G technology,which has caused significant negative impact on Huawei’s production and operation.This paper intends to analyze the origin,evolution and trend of the US export control legal system based on US export control measures against Huawei,assess the impact on China and offer suggestions for countermeasures that China should take.
