摘要
审查运用“一对一”证据的难点在于证据提供者具有提供虚假证据动力、难以通过印证规则验明证据真伪以及非“一对一”言词证据易异变为“一对一”证据。审查运用“一对一”证据需遵循一定的基本原则,主要包括直接言词、自由心证和有利于被告等三项。审查运用“一对一”证据的逻辑进路,从证明模式角度看,相较“证实”应更侧重“证伪”;从证明依据角度看,相较证明的“外部性”应更侧重证明的“内部性”。“一对一”证据作为证据矛盾的一种子类型,矛盾分析法为审查运用“一对一”证据提供了依循,不仅应关注“一对一”证据与“案情、常理”“重要证据”间的矛盾,也应注意分析围绕案件非关键事实而形成的“一对一”证据矛盾。
The difficulty of examining the application of"one-to-one"evidence lies in the fact that evidence providers have the motivation to provide false evidence.It is difficult to verify the authenticity of evidence through verification rules,and non-one-to-one verbal evidence is easy to change into"one-to-one"evidence.The examination and application of"one to one"evidence should follow certain basic principles,including direct speech,free psychological evidence and benefit to the defendant.From the perspective of proof mode,we should focus more on"falsification"than"verification".From the point of view of proof basis,we should pay more attention to the"internality"of proof than the"externality"of proof."One to one"evidence as a seed types of evidence conflict,contradiction analysis provides a following review using the"one to one"evidence,evidence should not only pay attention to"one to one"and"case,common sense,""important evidence,the contradiction between"non-critical also should pay attention to analysis on case facts and form the"one to one"evidence of contradictions.
