摘要
随着互联网技术的发展,代码技术的影响力由虚拟网络空间延伸至现实物理空间。代码技术不仅是虚拟世界中的“法律”,也正在成为现实世界中潜在的“规制者”。在“规制”逻辑的影响下,代码技术逐渐具有了“反自由”属性,作为人之主体性重要支撑的自由价值逐步被消解与重塑。代码技术对自由的限制缺乏正当性依据,根本原因在于代码技术背后的控制者以一种欠缺法律背书的方式为自由设置不合理的限制。从现代法治立场出发,对自由的限制存在严格的实质性标准与形式性程序,远非代码技术自治规则所能决定。面对代码技术的“反自由”属性,必须运用法律手段对代码技术进行规制。在回应代码技术引致的自由危机这一问题上,传统的法律治理手段在权力逻辑、监管模式与治理结构上均存在问题。应当在坚持主体性自由原则的前提下,推进既有治理体系的完善。
With the advance of Internet technique, the influence of code technique extends from virtual network space to real physical space. Code technique is the “law” in the virtual world as well as the potential “regulator” in the real world. Due to the impact of“regulation” logic, code technique gradually has the property of “anti-freedom”, and the value of freedom, an indispensable support of human subjectivity, is gradually dissolved and reshaped. The fundamental reason is that the controller behind the code technique sets unreasonable restrictions on freedom in a way lacking legal endorsement. From the standpoint of modern rule of law, there are strict substantive standards and formal procedures for the restriction freedom, which are far from being determined by autonomy rules of code technique. Facing the “anti-freedom” property of code technique, legal regulation must be taken. Traditional legal governance means have difficulties in power logic, supervision mode and governance structure to deal with the freedom crisis caused by code technique. We should improve the existing governance system on the premise of adhering to the freedom principle of human subjectivity.
