摘要
IUU捕捞是南海渔业问题的重要方面,治理南海IUU捕捞是促进南海渔业资源可持续发展的必然要求,是宣介中国主张、中国智慧、中国方案的宝贵路径,更是新时代下中国加快建设海洋强国的重要体现。有效治理南海IUU捕捞,应当切实考察现实所需,这是展示中国治理之策、宣介中国治理之维的根本前提。同时,要从立法、执法和司法层面深刻反思现有治理举措的缺憾,紧追国际治理大势,尽早建构起成体系的中国方案。方案需要全面展示中国立场,对内可以起到保障中国南海渔民的合法权益的作用,对外则可以对周边渔船形成有效制约。同时考虑到南海自身的地缘复杂性和沿岸国间的密切关联性,寻求合作平台的协调作用也应当成为方案的主要内容。
IUU fishing is an important aspect of the fishery problem in the South China Sea.Governing IUU fishing is an inevitable requirement to promote the sustainable development of the South China Sea fishery resources.It is also an important manifestation of China’s acceleration of building a maritime power in the new era and a valuable path to introduce China’s propositions,wisdom and solutions.To effectively control IUU fishing in the South China Sea,China has to firstly examine its actual demands,which is the prerequi⁃site for publicizing China’s governance policies and values.At the same time,it must deeply reflect on the shortcomings of existing governance measures from the legislative,law enforcement,and judicial levels,closely follow the general trend of international governance,so as to construct a systematic Chinese plan as soon as possible.The plan should be able to demonstrate China’s all⁃sided position,which internally well protects the legitimate rights and interests of Chinese fishermen in the South China Sea,and externally ef⁃fectively controls surrounding fishing vessels.Taking into account the geological complexity of the South China Sea and the close ties of the coastal countries boarding it,seeking the coordination function of a coop⁃eration platform should also become a major content of the plan.
