摘要
作为最高人民法院近六年来首次依法以行政调解方式审结的典型行政案件,“林建国案”宣示了司法调解所具有的促进行政争议实质性解决功能。当下我国人民法院在行政争议实质性解决过程中存在明显的协调和解路径偏好,应当在新行政诉讼法的体系化解释中予以解构。行政争议实质性解决是一个以依法判决为主导、以司法调解和协调和解为补充、以其他辅助机制为配套的基本构造,司法调解因具有可视正义而处于优先适用地位。行政审判实践中司法调解补充性机制的失灵,源于法律文本规定自身的局限、行政审判考评的现实压力和当事人双方复杂的社会心态。为了激活司法调解在行政争议实质性解决中的补充性作用,应当通过制定专项司法解释、构建科学考评体系、规范典型调解案例发布等三个方面进行保障。
As the first typical administrative case concluded by administrative mediation by the Supreme People’s Court in the past six years,the“Lin Jianguo Case”has declared the function of judicial mediation to promote the substantive resolution of administrative disputes.In the process of substantive resolution of administrative disputes.At present,the people’s courts have obvious preference for coordination and reconciliation,which should be deconstructed in the systematic interpretation of the new administrative litigation law.The substantive resolution of administrative disputes is a basic structure that is dominated by judgment according to law,supplemented by judicial mediation,coordinated reconciliation,and complemented by other auxiliary mechanisms.Judicial mediation is in a priority application due to visual justice.The failure of the supplementary mechanism of judicial mediation in trial practice stems from the limitations of the legal text stipulations,the practical pressure of administrative trial evaluation and the complicated social mentality of both parties.In order to activate the supplementary role of judicial mediation in the substantive resolution of administrative disputes,it should be ensured through the introduction of special judicial interpretations,the establishment of a scientific evaluation system,and the norm of the release of typical mediation cases.
