摘要
刑法修正的议程设置逻辑具有模糊性,可引入多源流框架予以厘清。基于多源流框架的核心概念、基本命题以及刑法修正的特殊性,可以确定刑法修正议程设置的多源流分析框架。其中,实害指标或风险预警、焦点事件、刑法实施反馈、前置法变动是其问题源流的形成机制,政策共同体尤其是刑法学者的出入罪建议是其政策源流的形成机制,执政党理念、政治精英的推动、国民情绪是其政治源流的形成机制。当三流融合、政策溢出效应显现之时,政策之窗开启,刑法修正的议题受政策活动家的推动进入立法议程之中。多案例检验和单案例深描显示,多源流框架对刑法修正的议程设置逻辑具有解释力,这一分析有助于刑法修正议程设置理论的建立和发展。同时,刑法修正的特别之处也可以为多源流框架的发展提供智识启迪,有助于拓展多源流框架的知识资源和适用范围。
The agenda setting for criminal law amendment is fuzzy,and it can be clarified by introducing multiple streams framework.Based on the core concept,basic proposition,and particularity of the amendment of criminal law,the multiple streams framework for criminal law amendment can be determined.Among them,the formation mechanism of problem streams are the actual harm index and risk warning,focus event,criminal law implementation feedback and the change of the prepositive law.The policy community,especially the criminal law scholars'suggestion for setting or abolishing a crime,are the formation mechanism of policy streams.The ruling party's philosophy of law,the promotion of political elite and the national mood are the formation mechanism of political streams.When the three streams converge and policy spillover effect appears,the policy window opens,and the issue of criminal law amendment is pushed into the legislative agenda by policy activists.The test on multiple cases and deep description on single case show that the multiple streams framework has explanatory power to the agenda setting logic of criminal law amendment,which is helpful to the establishment and development of the agenda setting theory of criminal law amendment.At the same time,the special points of criminal law amendment can provide enlightenment for the development of multiple streams framework,which will help to expand the knowledge resources and application scope of the framework.
