摘要
重大疫情期间,涉疫刑事犯罪直接干扰疫情防控工作大局,破坏社会治安秩序和社会管理秩序,严重危害人民群众的人身和财产安全。在惩治犯罪过程中系统梳理妨害疫情防控的刑事犯罪类型,综合研判重大疫情期间刑事犯罪态势;统筹办案原则与办案质效,兼顾防疫安全与权利保障,平衡刑事打击与源头治理;探索健全刑事案件办理机制、协同推进重大疫情防控、推动刑事犯罪社会治理等全面有效的司法应对策略和方法,可以从严从快惩治涉疫刑事犯罪,实现“三个效果”的有机统一。
During the major epidemic,criminal crimes related to the epidemic directly interfered with the overall situation of epidemic prevention and control,undermined the order of public security and social management and seriously endangered the personal and property safety of the people.In the process of punishing crimes,systematically sort out the types of criminal crimes that hinder the prevention and control of the epidemic,comprehensively study and judge the criminal situation during the major epidemic;coordinate the principle of case handling and the quality and effect of case handling,take into account the safety of epidemic prevention and rights protection,and balance criminal strikes and source governance;explore comprehensive and effective judicial response strategies and methods such as improving handling mechanisms of criminal cases,coordinated promoting major epidemic prevention and control,and promoting social governance of criminal offenses,can punish epidemic-related criminal crimes strictly and promptly,and achieve the organic unity of the“three effects”.
