摘要
宅基地三权分置政策的目的是盘活利用宅基地和住宅,促进农村经济社会发展。在宅基地改革试点推进中,已形成包括宅基地有偿使用、宅基地换置、宅基地使用权抵押和宅基地资格权退出等成功实践,但仍面临着宅基地三权分置中所有权主体虚位、使用权权能不完整和资格权立法缺失等法律困境,同时现有法律制度限制了宅基地使用权的流转范围,宅基地流转的配套措施也明显不足。因此,一方面要推动宅基地三权分置政策立法,即强化宅基地集体所有权、完善资格权立法和充实使用权权能, 另一方面也要有限制地放活宅基地使用权的流转范围并构建统一的城乡社会保障体系,以推动宅基地三权分置改革,促进乡村振兴战略的实现。
The purpose of the policy of separation of three rural residential land rights is to revitalize the use of rural residential land and housing,and promote rural economic and social development.In the process of the pilot project of rural residential land reform,successful practices have been formed,including paid use of rural residential land,rural residential land replacement,mortgage of use right of rural residential land and exit of qualification right of rural residential land,however there still confronted some legal predicaments,such as the nullity of ownership subject,the incompleteness of use right and the lack of qualification legislation,at the same time,the current legal system restricts the transfer range of use right of rural residential land,and the supporting measures of transfer of rural residential land are also obviously insufficient.Therefore,on the one hand,we should promote the legislation of the policy of the separation of three rights of rural residential land,strengthen the collective ownership of rural residential land,improve the legislation of qualification right and complete the functions of use right of rural residential land;On the other hand,we should restrict the transfer range of use right of the rural residential land and construct a unified urban and rural social security system,to promote the reform of the separation of three rights of rural residential land and improve the implementation of the Rural Revitalization Strategy.
