摘要
教育治理体系与治理能力现代化是我国教育强国建设的重要内涵,依法治教是教育治理体系与治理能力现代化的内在要求。在全面推进依法治教的过程中还遇到不少挑战,集中表现在教育法治思维匮乏、教育立法建设滞后和教育行政执法弱化等方面。为此,必须坚持以人民为中心、从实际出发、以生为本等基本原则,创新立法机制,严格执法程序,普及法治文化。福建省通过率先创制、简政放权、强化研究和多维联动等举措,实现了治理机制建设的突破,对我国依法治教的长效机制探索具有借鉴意义。
The modernization of education governance system and governance capacity has important implication for China’s advancement through the development of education.The governance of education in accordance with law is the inherent requirement of education governance system and governance capacity.In the process of comprehensively promoting the rule of law in education,there are still many challenges,such as the lack of legal thinking in education,the delaying of legislation on education and the weakening of administrative law enforcement in education.In order to overcome those challenges,it should be stick to such fundamental principles as taking the people as the center,implementing measures based on reality and taking students as the essential.In the meantime,a series of measures should also be carried out,such as,innovation of legislative mechanism,strict enforcement of law and popularization of the rule of law culture.Fujian Province has achieved a breakthrough in the above fields by carrying out the measures like comprehensive innovation,downsizing administration and lowering power,strengthening research and multidimensional cooperation,which has referential significance for the exploration of the long-term mechanism of governing education in accordance with law.
