摘要
陪审制度改革是我国当前司法改革的重要内容之一,专家陪审制的发展过程反映了科学技术发展对诉讼制度提出的新要求。环境诉讼专家陪审制是人民陪审员制度的特殊表现形式,其主要功能是满足环境诉讼专业化需求,实现以审判为中心的改革需求。通过专家陪审员与职业法官之间“事实审”与“法律审”职权配置的多元化模式,实现环境诉讼专家陪审制裁判权运行最大功效。环境诉讼专家陪审制裁判权的有效运作,离不开公正、科学的法律程序支撑。
The reform of jury system is one of the important contents of the current judicial reform in China.The development of expert jury system reflects the new requirements of science and technology development on litigation system and the impact it brings.Expert jury system in environmental litigation is a special manifestation of people’s jury system.Its main function is to meet the needs of environmental litigation professionalization and to achieve the goal of trial-centered.Through the diversified mode of“the trial of fact”and“the trial of law”power allocation between expert jurors and professional judges,the expert jury system of environmental litigation pursues the maximum efficiency of the operation of jurisdiction.The effective operation of expert jury system in environmental litigation can not be separated from the support of fair and scientific legal procedures.
