摘要
选择我国《建设项目工程总承包合同示范文本(2020版)》与FIDIC出版的《Conditions of Contract for EPC/Turnkey Projects(2017版)》为研究对象,从现场数据、开工日期、进度计划、暂停施工及复工、支付、不可抗力等合同条款详细对比两种合同范本的风险机制,以及差异对承包商造成的不同影响,评价我国工程总承包合同示范文本风险机制的合理性和进步性,为我国发承包双方使用示范文本提供参考。
Selects the“EPC general contract demonstration text of China(2020 edition)”and“FIDIC EPC/Turkey contract conditions(2017)”as the research object.From the clauses of site data,commencement date,project schedule,suspension and resumption,payment,exceptional events.A detailed comparison of the risk mechanisms of the two contract templates,as well as the different impacts of this risk mechanism on contractors,evaluate rationality and progress of China’s EPC general contract risk mechanism,so as to provide reference for Employers and Contractors.
