摘要
在劳动法领域,劳动合同无效是否能作为合同解除的条件一直以来是一个有争议的话题,此文章将从正反两方面分析该观点,同时提出可以从细分无效合同的类别与无效情形,打造有效与无效二元体系、限缩“无效的概念”,借鉴民法典,这三个方面来完善立法以化解该难题。
In the field of labor law,it has always been a controversial topic that if the invalidity of labor contract can be regarded as a condition of the termination of the contract.This paper analyzes the pro and con and puts forward the solution to the problem to perfect legislation from three aspects:subdividing the categories and situations of invalid contracts;creating valid and invalid binary system;narrowing the concept of"invalid"and using Civil Code for reference.
