摘要
对网络大病众筹平台的研究,有利于解决近年来网络大病众筹中的乱象,促进社会和谐有序。通过研究发现,网络大病众筹存在诸多问题,主要体现为影响对患者的及时救治、违法众筹现象的产业化发展以及引发社会信用的缺失。其产生的原因是法律关系模糊不清、相关法律规范适用困难、缺乏必要的行政介入以及平台经营管理上存在隐患。对此,文章提出理清平台与各方主体的法律关系、灵活适用既有的法律规范、加强对平台的行政监管与扶持、改良平台经营管理等举措,以净化网络大病众筹环境。
The research on the crowdfunding platform for serious diseases in the network will help to solve the chaos of crowdfunding for serious diseases in the network in recent years,and promote the harmonious and orderly development of so⁃ciety.The study found that there are many problems in crowdfunding for serious diseases in the network,mainly reflected in the delay in timely treatment of patients,the industrialization of illegal crowdfunding phenomenon and the lack of social cred⁃it.The reasons are unclear legal relationship,difficulties in the application of relevant laws and regulations,lack of necessary administrative intervention and hidden dangers in the operation and management of the platform.In this regard,this paper proposes to clarify the legal relationship between the platform and all parties,flexibly apply the existing legal norms,strength⁃en the administrative supervision and support of the platform,and improve the operation and management of the platform,so as to purify the crowdfunding environment of serious diseases in the network.
