摘要
中国国内航行海船航区划分问题从1955年制定船舶建造规范时就开始研究,历经最初的暂定离岸100海里以内,到现在的四类航区精细划分,对国内沿海航运业的快速发展作出了不可替代的贡献。但现行的国内航行海船航区划分在海事监管中难以做到精准判别海船是否超航区航行,在民商事活动中也因为界定船舶是否超越航区航行而争议不断,文中浅谈国内航行海船航区划分中存在的部分问题,并提出了相应的修订建议。
The issue of the division of navigation zones for vessels engaged in domestic offshore voyages has been a focus of research since 1955,when the Code for the Construction of Vessels was formulated.Starting from the initial tentative 100 nautical miles off the coast to the present four categories of navigation zones,the evolution and study of navigation zone division has making irreplaceable contributions to the development of China's coastal shipping industry.However,it is difficult to accurately determine whether a ship is sailing beyond the navigation zones under the current categorization of navigation zones in maritime administration,and there are many disputes in civil and commercial activities resulted from the definition of whether the ship concerned is sailing beyond the navigation area.The paper briefly addresses some problems existing in the division of navigation area for domestic seagoing vessels and puts forward corresponding suggestions for revisions.
