摘要
两用物项出口管制是美国维护其所谓国家安全和外交政策利益的重要工具之一。近年来随着中国经济和科技实力的稳步提升,以信息和通信技术为代表的高科技行业迅猛发展,美国高附加值的高科技产业面临着来自中国企业的严峻挑战。因此,特朗普政府加强了对我国的两用物项出口管制,不仅颁布了新的出口管制法案,频频将中国实体纳入实体清单,还加强了对华出口审查,整体呈现出长臂管辖愈发频繁、管制程度更趋严格、管制针对高科技行业的特点。美国对华两用物项出口管制无疑对两国的高新技术产业发展、技术创新、贸易平衡都会有负面影响,我国相关企业应切实做好准备和加强应对。
The dual-use item export control has always been one of the important tools for the U.S.to maintain its national security and foreign policy interests.In recent years,with the steady improvement of China's economic and technological strength,the high-tech industry represented by information and communication technology has developed rapidly,and the high-value-added high-tech industry in the U.S.is facing severe challenges from Chinese companies.Therefore,the Trump administration has strengthened the export control of dual-use items to China,not only promulgated a new export control bill,and frequently included Chinese entities in the entity list,but also strengthened its review of exports to China.The U.S.export control to China is characterized by more frequent longarm jurisdiction,stricter control,and high-tech industry control.The U.S.export control of dual-use items to China will undoubtedly have a negative impact on the development of high-tech industries,technological innovation,and trade balance between the two countries.China's relevant enterprises should be prepared and strengthen their response.
