摘要
为应对日益严峻的社会信用危机,弥补传统信用德治和现有法律的不足,亟待建立社会信用法治体系。信用立法,将诚信与法治相融合,是建设社会信用法治体系的前提。信用立法具有理论基础。基本道德具有转化为法律规范的可能性,而信用作为一种基本道德,因其评价结果的明确性和当事人关系的社会性,能够上升为法律规范。信用立法具有实践基础。地方立法的先行探索提供了实践经验,我国政府具备担任主管角色的职能和地位,现代化信息数据技术提供了技术支撑。
In order to deal with the increasingly severe social credit crisis and make up for the deficiency of traditional credit rule by virtue and existing laws,it is urgent to establish a legal system of social credit.Credit legislation,the integration of credit and the rule of law,is the premise of building a legal system of social credit.Credit legislation has theoretical basis.The basic morality has the possibility to be transformed into legal norms,and credit,as a basic morality,can be upgraded to legal norms because of the clarity of its evaluation results and the sociality of the relationship between the parties.Credit legislation has practical basis.The first exploration of local legislation provides practical experience.The Chinese government has the function and position of being in charge,and the modern information data technology provides technical support.
