摘要
近些年学界对法制史研究呈现出比较明显的特点,主要是研究史料的丰富扩大了研究视野,众多学者开始持续关注争议性问题并进行一定的学术论证辩驳,在研究方法上立足法律全球化视角来更新史学者的知识体系和现代世界观等。当然在今后的研究过程中更要注重“法律的历史”与“历史的法律”的双重把握,秉持兼具范式转换与思路创新的理念。
In recent years,the academic circles have shown more obvious characteristics in the study of legal system history,mainly in the enrichment of research historical materials and the expansion of research horizons.Many scholars have begun to pay attention to controversial issues and conduct certain academic arguments and defenses,updating the knowledge system and modern world outlook of historians,with their research methods based on the perspective of the globalization of law.In the future research process,we should pay more attention to the dual grasp of“the history of law”and“the historical law”,and uphold the concept of both paradigm shift and thinking innovation.
