The Important Value of the Life Dignity Stipulated in the Civil Code

摘要《中华人民共和国民法典》第1002条在生命权的内容中规定了“生命尊严”,这是一项非常重要的规定。从抽象的人性出发,生命尊严是人的主张;从具体的人出发,主张生命尊严是伦理人的内在道德要求。在此基础上,主张生命尊严的终极目的是维护人格尊严,应当受到人格权法的保护。可见,《中华人民共和国民法典》第1002条把生命尊严作为生命权的基本内容具有深厚的理论和社会基础。生命尊严不仅是人格尊严的具体展开,也是生命权的终极理据。以死的尊严为核心,其具体内容包括尊严死、生前预嘱和临终关怀等。由此可见,《中华人民共和国民法典》第1002条规定生命尊严具有的重要价值,就是完整保护人格尊严,通过扩展生命权的内容,充分保障死的尊严,并为尊严死、生前预嘱、临终关怀等提供立法依据,亦为安乐死的合法性评价预留解释空间。 Article 1002 of the Civil Code,which provides for "dignity of life" in the content of the right to life,is a particularly important provision. From the abstract human nature,the dignity of life is the human proposition. From the concrete human being,the proposition of life dignity is the moral requirement of ethical human beings. On this basis,the ultimate goal of advocating the dignity of life is to maintain the dignity of the human being,which should be protected by the law of the right of personality. It can be seen that article 1002 of the Civil Code has a profound theoretical and social basis for taking the dignity of life as the basic content of the right to life. The dignity of life is not only the concrete development of human dignity,but also the ultimate rationale of the right to life. With the dignity of death as the core,its specific content includes dignified death,hospice care and pre-orders. It can be seen that Article 1002 of the Civil Code stipulates that the dignity of life has important value,that is to fully protect the dignity of the human person and realize the main value of fully guaranteeing the dignity of death by extending the content of the right to life,provide legislative basis for dignified death,pre-orders,hospice care,etc.,and provide room for interpretation of the legality evaluation of euthanasia.
