摘要
党政机关习惯于组建临时性的应急指挥机构,负责突发公共卫生事件的应急指挥工作。为有效应对新冠肺炎疫情,各地广泛组建了新冠肺炎疫情防控工作领导小组和指挥部,负责疫情期间的应急指挥工作。领导小组和指挥部的设立和运行遵循着特定的组织和运行规范。这些规范的主要成分是习惯法。其中的组织规范规定领导小组和指挥部的成立、命名、架构、定位、权责等设立事项,运行规范则规定领导小组和指挥部的信息收集、信息处理、决策形成、指令输出等运作活动。秉承着统一指挥、秩序为重、集中力量、依靠群众、及时高效的基本原则,领导小组和指挥部的组织与运行规范为指挥机构的设立和运作提供了正当化依据及规范化基础。应当注重对成熟习惯规范的总结和提炼,完善特殊状态下的国家法律。
The party and government organs are used to setting up temporary emergency command organizations to be responsible for the emergency command of public health emergencies. In order to control Covid-19, we have established a new leading group and command department for the prevention and control. The establishment and operation of leading group and headquarters follow specific organization and operation norms. The major components of these norms belongs to customary law. Among them, the organizational norms stipulate the establishment, naming, structure, positioning, rights and responsibilities of the leading group and the headquarters, while the operational norms define the information collection, information processing, decision-making, command output and other operational activities of the groups and headquarters. Adhering to the basic principles of unified command, focusing on order, concentrating strength, relying on the masses timely and efficiently, the organization and operation norms of the leading group and headquarters provide the legitimate basis and standardized basis for the establishment and operation of the command organizations. We should pay attention to the summary and refinement of mature customary norms and perfect the national laws under special conditions.
