摘要
动产流动质押作为一种新型的动产担保,将融资企业、金融机构和物流企业联系在一起,是物流金融创新的产物。物流企业监管过程中,面临出质人强行出库、质物减损、监管解除不当等多种法律风险。界定监管义务的范围、明确监管义务的履行方式是规避风险的重要手段。
Dynamic pledge of movable properties,as a new type of chattel guarantee,connects financing enterprises,financial institutions and logistics enterprises,and is the product of logistics financial innovation.In the process of supervision,logistics enterprises are faced with various legal risks,such as forcibly taking the pledge out of the warehouse by the pledgor,the loss of the quality of the pledge,and improperly relieving of supervision.It is an important means to avoid risks to define the scope of supervision obligations and to define the way to fulfill them.
