摘要
对于赌博借贷效力的质疑源自其与赌博的密切联系,尽管我国民法体系未明文规定赌债的效力,但从刑法与行政法的规范可以知悉,我国立法者持禁赌与保护赌博人免于经济困难的双重目的,因此对于赌债呈现禁赌和不予保护两种价值判断。在公私协动论的视角下,民法应当致力于实现一国整体法秩序所体现的规制目的,贯彻两种价值判断。因此,在民法体系中,应当构建违法赌债、不完全保护赌债和合法赌债三种类型。三种类型下,与之相应的赌博借贷是否因出借人明知借款人借款用于赌博活动而无效,需要根据借款时间、赌债类型和出借人的主观状态等不同的要素构建动态体系,实现要件与法律效果的弹性化。
The doubt about the effectiveness of gambling debt loan stems from its close connection with gambling.Although the civil law system does not expressly stipulate the effectiveness of gambling debts,it can be learned from the norms of criminal law and administrative law that Chinese legislators try to forbidden the gambling and protect gamblers from the economic hardship.Therefore,consideration of the value is also this dual purpose,namely the gambling should be forbidden and the debt should be not protected.From the perspective of corporation of the public-private law,the civil law should aim to achieve the regulatory purposes,which is embodied in the overall law order of a country.Therefore,in the civil law system,three types of illegal gambling debts,incomplete protection of gambling debts and legal gambling debts should be constructed.Whether the corresponding gambling loan is invalid because the lender knows that the borrower borrows for gambling activities,should be considered under the three type of gambling debt.A dynamic system should be constructed according to different factors such as borrowing time,gambling type and subjective state of the lender.The purpose of such construction is to flexible the component and legal effects.
