摘要
中医起于民间,用于民间,兴于民间。传统中医人才的培养主要包括师带徒、家传和自学成才三条途径。现有法律尤其是《执业医师法》对中医师行医资质门槛设置过高,各地考核中医医术确有专长人员医师资格的条件比较苛刻,致使很多年纪长、学历低但具有丰富行医实践且疗效口碑俱佳的民间中医沦为"非法行医",这非常不利于中医医术的传承与发展。建议修改《执业医师法》和确有专长人员医师资格的考核条件,放宽对民间老中医行医资质的限制,尤其是降低对经多年中医医术实践通过中医医术确有专长人员医师资格考核中指导老师和推荐老师的数量和资质要求,加强对申请者本人医术实践技能的考核,为家传和自学成才的中医人行医资质安排出路。
Chinese Medicine originates from the civil society,is used by the civil society,and is developed in the civil society.The training of Traditional Chinese Medicine(TCM)talents mainly consists of three ways:educated and practised under the instruction by an elder TCM practitioners,family tradition and self-study.The current laws and regulations,especially the"Law on Medical Practitioners",set a high qualification of folk TCM practitioners.The local government assess the performance of folk TCM practitioners stringently.It makes a lot of elder TCM practitioners lack of the legal right to TCM treatment who are low-educational but rich in TCM practice.It is not conducive to the inheritance and development of TCM.It is recommended to amend the"Law on Medical Practitioners"and to lower the qualification of folk TCM practitioners by local government.It is recommended to reduce the quantity and quality of licensed doctors as instructors and to strengthen the applicant’s own medical practice skills performance and to arrange a way for folk TCM practitioners who are self-taught and who are educated by family instructors.
