摘要
在新的时代背景下,检察机关的职权性质再次受到新的挑战。这些挑战在一定程度上源自对检察机关法律监督地位的不同理解。要树立中国特色社会主义检察制度的理论自信,就有必要从检察与监察的界分、检察与行政执法的区别、检察与法律监督的关系、监督与制约的联系与区别等方面,进一步阐述法律监督的内涵,深刻认识法律监督在国家权力监督体系中的特殊性,坚持检察机关的宪法定位。同时,要适应新时代的要求,进一步更新法律监督理念,明确法律监督的价值追求和实现方式,更好地发挥检察机关在全面推进依法治国中的职能作用。
In the context of the new era, the nature of the procuratorial authority is challenged again. These challenges stem, to some extent, from a different understanding of the role of legal supervision in the prosecution. In order to set up the confidence to the socialism theory with Chinese characteristics of procuratorial system, we should further expound the connotation of the legal supervision from the definition of the procuratorial and supervisory authority, the difference between the procuratorial and administrative enforcement, the relationship between the prosecution and legal supervision, and the connection and distinction between the supervision and restriction. In this way, we can have a deep understanding of the particularity of legal supervision in the supervision system of state power and adhere to the position of procuratorial organs in the constitution. At the same time, it is necessary to further update the concept of legal supervision, and clarify the value pursuit and realization approach of legal supervision according to the requirements of the new era, so as to play a better role of procuratorial organs in comprehensively promoting the rule of law.
