农村留守儿童监护制度的模糊与澄明 被引量:6

摘要 留守儿童监护制度是我国一项重要的政策,它保障了儿童的生命安全,健康成长。但农村留守儿童委托监护人的合法性、监护能力的评估、监护的职责、监护的实施以及监护的监管在现有法律文件中存在模糊现象,造成监护的空位、"让位",相互推让职责,致使留守儿童监护陷入困境。澄明制度的模糊,明确农村留守儿童监护的各个环节,界定监护人的法定资质、落实监护权的主动备案制、构建纵横交错的监护集体、发挥学校的监护价值、明确第一法定监护人的职责、理清监护权的边界和内涵、确定儿童监护层级的任务,以及加强监管制度的建设等,以此保障留守儿童的权益,守卫儿童的健康成长。 The guardianship system of left-behind children is an important policy in China, which guarantees the safety and healthy growth of children. However, the legality of the entrusted guardians, the evaluation of guardianship ability, the duty of guardianship, the implementation of guardianship, and the supervision of guardianship are ambiguous in the existing legal documents, resulting in the vacancy of guardianship, "abdication" and mutual responsibility, resulting in the plight of guardianship of left-behind children. Clarify the fuzziness of the system, clarify all aspects of the guardianship of left-behind children in rural areas, define the legal qualification of guardians, implement the active record system of guardianship, build a crisscross guardianship collective, play the guardianship value of the school, clarify the responsibilities of the first legal guardian, clarify the boundary and connotation of the supervision right, determine the tasks of the child guardianship level, and strengthen the construction of the supervision system to protect the rights and interests of the left-behind children and the healthy growth of children.
