摘要
近十年来,在我国慈善事业快速发展的同时,慈善组织的公信力也在不断地遭遇挑战,公信力下降已成为阻碍我国慈善事业进一步发展的主要障碍。慈善组织公信力危机的形成机理是在以"局外人"监督为主的条件下,由信息不对称导致的监督不充分使社会公众对慈善组织的失范行为作出了过度的解读。为了提升和保护慈善组织的公信力,必须充分发挥慈善监察人的作用,使对慈善组织的监督从以"局外人"为主向以"局内人"为主转变,在强化慈善组织行为约束的同时,防止其公信力遭受与其失范行为不对等的过度冲击。目前慈善监察人制度的实施范围狭窄,监察人发挥的作用有限,必须在扩展监察人制度的同时,从准入和选任、辞任、解任和变更、履职条件等方面,对该制度加以完善。
In the past decade, with the rapid development of philanthropy in China, the credibility of charity has been constantly challenged. The decline of credibility has become the main obstacle to the further development of philanthropy in China. The mechanism which reduces to trust crisis of charity is that the outside supervisors’ inadequate supervision for the sake of asymmetric information makes the public over interpret the misbehavior of charity. It is necessary for enhancing and protecting the credibility of charity to give full play to the role of charity supervisors, so that the main supervisors of charity can be changed from "outsiders" to "insiders", and then prevent the credibility of charity from being impacted excessively which is not equal to its misbehavior while making further efforts to regulating the behavior of charity. At present, the implementation scope of the charity supervisor system is narrow, and the role of the supervisors is limited, so it is necessary to expand the supervisor system, and improve the system in terms of access, selection, resignation, dismissal, change and performance conditions of supervisors.
