摘要
党与行政执法之间存在着保证关系,党"保证"执法的实践逻辑主要通过政治、思想、组织保证来展开。具体而言,党保证执法的政治运作机制包括把握原则方向的宏观政治保证、依托党政组织的中观政治保证、规范工作方式的微观政治保证等内容;党保证执法的思想保证机制主要通过让法治成为社会的主流意识形态、建设法治型政党、建设法治政府、建设法治文化等途径进行;党保证执法的组织保障机制重点要求在组织架构中保持党政之间的适度张力、在组织运行中发扬民主集中制、在组织体系建设中坚持党管干部原则。
There is a guarantee relationship between the party and the administrative law enforcement. The practical logic of the party’s "guarantee" law enforcement is mainly carried out through political, ideological and organizational guarantees. Specifically, the political operation mechanism of the party’s guarantee of law enforcement includes the macro political guarantee of grasping the principle direction, the meso political guarantee of relying on the party and government organizations, and the micro political guarantee of standardizing the working methods. The ideological guarantee mechanism of the party’s guarantee of law enforcement mainly includes making the rule of law become the mainstream ideology of the society, building a party of the rule of law, building a government of the rule of law, and building a culture of the rule of law. The organizational guarantee mechanism of the party’s guarantee of law enforcement focuses on maintaining the appropriate tension between the party and the government in the organizational structure, carrying forward the democratic centralism in the organizational operation, and adhering to the principle of the party managing cadres in the construction of the organizational system.
