摘要
2008年以来,公序良俗在司法裁判中的应用快速增加。在当下中国的司法实践中,公序良俗至少发挥了三个层次的司法功能:一是发挥了"查明"功能,被用来查明案件事实;二是发挥了"限制"功能,被用来"限制民事行为"或"限制规范适用";三是发挥了"适用"功能,被用来直接裁判案件。为了避免公序良俗司法应用的说理陷入无意义的语词循环和主观化、任意化的巢窠,必须将"社会主义核心价值观"这一核心法理作为公序良俗司法应用之理据。在司法实践中,法官或将"社会主义核心价值观"与"公序良俗"并列使用,或将前者隐含在"公序良俗"中予以使用。为了保障公序良俗司法应用的科学性、统一性和充分性,必须建立公序良俗司法应用的实证机制:在客观层面,应当确保形成类型化的公序良俗司法应用模式;在主观层面,应当确立一种"可接受性"的裁判路径。
Since 2008, the application of public order and fine custom(POFC) in judicial decisions has shown an exponential growth trend. In the current judicial practice of China, POFC have formed at least three levels of judicial functions: the functions of"ascertaining"to ascertain the facts of the case;the"restricting"functions to"restrict civil conduct"or"restrict the application of norms";the"applicable"functions for the direct adjudication of cases. In order to avoid the judicial application of POFC falling into the meaningless language cycle and the nest of subjectivization and arbitrariness, we must take"socialist core values", the core Fali, as the grounds of the application of POFC. Judges either use"socialist core values"side by side with"POFC"in judicial practice, or use it implicitly in"POFC". In order to ensure the scientificity, unity and sufficiency of the application of POFC, it is necessary to establish an empirical mechanism of the application of POFC: on the objective level, it is necessary to ensure the formation of a typed application mode of POFC;on the subjective level, it is necessary to establish a judgment path based on"acceptability".
