摘要
当今涉枪行为的刑法治理,存在着枪支管控效果不佳、司法裁判屡遭质疑、相关规范适用存疑的三方面困境。涉枪行为治理现状的困境表明,如此的涉枪行为刑法治理模式,并未带来乐观的治理效果。这既因立法突破犯罪基本特征的失位,也因司法未能精准把握犯罪特征的失守,还因执法的常态性失衡,从而导致涉枪行为刑法治理模式的错位与越位。其实质是传统"社会管理"的国家治理模式在枪支治理上的必然结果和客观体现。鉴此,涉枪行为的有效治理,应随着国家治理体系和治理能力的现代化转型,回归和整合刑法治理的功能与地位,在观念上实现从国家本位向社会本位的革新,在功能上实现从"政策法"向"保障法"的变革,在目标上实现从"秩序稳定"向"福利增进"的转向,并在刑法治理体系上,推行刑法内外治理的协调与重塑。既在刑法体系内,以犯罪概念的社会危害性、刑事违法性和应受刑罚惩罚性为非法持枪等涉枪犯罪的立法与司法标尺,以限制刑法治理的越位与错位,又在刑法体系外,以多元枪支法律管理体系为非法持枪治理的必要有机组成部分,以形成涉枪行为的常态性现代化治理体系。
At present three dilemmas exist as to the criminal governance of gun-related acts,that is,inefficient control of guns,doubts on judicial adjudication,queries on the application of relevant standards.The dilemmas are attributed to the criminal misplacing of legislation,the criminal misconduct of justice,and the constant lack of persistence of legal enforcement.In fact,they are related to the practice of social management in national governance.It is argued that reform should be made in that criminal law functions and status should be recovered and reinforced,society rather than state government should be emphasized,security-targeted law rather than policy-related law should be formulated,social order stability should move to welfare increments,and governance inside and outside criminal law should be coordinated.In this way gun-related acts are hopefully placed under effective and efficient governance.
