摘要 中国土地管理以用途管制为手段,“管制与规划”构成了土地治理的双轨模式。以土地利用总体规划为核心构建土地规划权体系,需要从不同角度梳理规划权的内容,以分级分类的方式对农用地、建设用地和未利用地进行合理规划,将“校正型、融合型、消极型”规划权与用途管制相接轨,搭建规划权体系的三层架构。土地规划权概念应作扩张性解释,除宏观层面的土地利用总体设计之外,还应包括微观层面的具体行政行为。在重视农民土地财产权保护的趋势下,不宜孤立地践行规划权的行政强制性,而是应当通过事先与事后相结合的规划模式与私权形成互动,从而协调规划权权力束与土地财产性权利束之间的关系,实现土地规划权内部体系和外部体系的统一。 Use regulation is the core means of land management in China,and planning and regulation constitute a dualtrack model of land governance in China.The planning right system is constructed around the overall land use planning as the core.The content of the planning right must be sorted out from different perspectives,and the agricultural land,construction land and unused land must be reasonably planned in a hierarchical classification manner,and then a three-tier structure of the planning right must be established.Aligning corrective,integrated,and passive planning rights with use controls.Expansive interpretation of planning rights should be included.In addition to the overall land use design at the macro level,specific administrative actions at the micro level should also be included.Under the trend of attaching importance to the protection of peasants'land and property rights,we should not enforce administrative c planning rights in isolation,but rather form an interaction with private rights by means of in advance planning and post-planning,so as to coordinate the relationship between the power group and property rights group,thus achieving the unity of the internal and external systems of planning rights.
