摘要
法治国家、法治政府、法治社会一体建设要求社会所有主体都应遵循国家统一法制。黑恶势力犯罪是一个兼具政治和法律否定性评价的概念,不应忽视其“建立违反国家统一法制的内部治理规则,进而形成一定区域内的非法控制”的本质。扫黑除恶本质上就是要恢复被黑恶势力犯罪破坏的法制秩序。我国扫黑除恶现状与一体建设的要求之间存在差距,体现为规范上存在法律依据冲突、实践中出现不当拔高或降低标准等问题。必须坚持法治国家、法治政府、法治社会一体建设,并落实科学立法、严格执法、公正司法、全民守法四个环节,以保证扫黑除恶行动在法治化、规范化的轨道上健康推进。
The construction of a country ruled by law,a government ruled by lawand a society ruled by lawrequires that all subjects of the society should follow the principle of unified legal system of the country.The crime of mafia-style Criminal Force is a concept with both political and legal negative evaluation,the nature of which is "establishing internal governance rules that violate the unified legal system of the country,thus forming illegal control in a certain region".The essence of eliminating evil is to restore the legal order destroyed by the crime.There is a gap between the current situation of anti-mafia and the requirement of integrated construction in China,which is reflected in the conflict of legal basis in the norms and the improper elevation or lowering of standards in practice.Therefore,we need to standardize the anti-mafia action in order to guarantee its healthy advancement on the track of standardization of the rule of law.
