摘要
福建、山东等多地政府投保“精神障碍患者监护人责任险”,与保险公司共享大数据,创新地以普惠性商业保险开展社会治理。经保险法理论检视,该险的保险标的“精神障碍患者监护人责任”属于可保风险,政府部门分别基于监护人责任、广义国家监护职责、综治兜底责任而拥有可保险利益。由于“精神障碍患者监护人责任险”具有普惠金融产品的特征,功能在于保障公共安全系属公共产品,政府运用财政资金投保具有正当性,符合“最有利于被监护人”原则。2017年《民法总则》对监护制度进行变革,“精神障碍患者监护人责任险”应依法将被保险人范围扩大至患者和组织监护人,从而为我国监护制度提供配套,为发展服务于公共政策目标的普惠保险提供经验。
Many local governments like Fujian and Shandong insure the Liability Insurances for the Guardians of Mental Disordered Persons.Such innovation utilizes the commercial insurance to achieve social governance.The object of this type of insurance,namely liabilities of the guardians of mental disordered persons,is a kind of insurable risk in light of insurability theory.The government obtains the insurable interest based on liability of the guardians,national guardianship and public security responsibility.Furthermore,it's legitimated for the government to pay the premium by financial fund.Because liability of the guardians is social liability in nature,and this type of insurance used for protecting social security belongs to the category of public good and inclusive insurance.Paying the premium by the government is in the best interest of the mental disabled person.The Chinese General Provisions of Civil Law has implemented the reform of Guardian System.The mental disabled person and the professional guardian organization should be integrated into the insured group by following the new Law.Such insurance is potential to be a supporting measure of Guardian System,and provide reference for other social managements involved in inclusive insurance.
