摘要
农村土地经营政策经历了私有私营、公有公营、家庭承包制下的"两权分离"到"三权分置"的演进。"三权分置"旨在解决农村土地的保障功能与农村土地效率利用之间的矛盾。党的不同时期的政治主张和任务引领着农村土地经营政策的演进方向,公平与效率的协调伴随着农村土地经营政策演进的整个过程。农村土地经营政策的演进反映出要充分发挥实践作用,试点先行,及时校正实践中的偏差;要循序渐进,注意政策的历史延续性,使法律确定政策实施中行之有效的成果。农村土地经营政策要与乡村振兴结合起来,立足于传统农户,与农村土地的适度规模经营相结合,在农村社会治理完善中不断进行优化调整。
Rural land management policy has undergone the evolution from private-owned and privateoperated,public-owned and public-operated and "separation of two rights"to "separation of three powers"under the household contracting system."Separation of three rights"aims to solve the contradiction between the guarantee function of rural land and the efficient use of rural land. The Party’s political opinions and tasks in different periods lead the evolution direction of rural land management policy. The coordination of equity and efficiency is accompanied by the whole process of rural land management policy evolution. The evolution of rural land management policy reflects the needs to give full play to the role of practice,implementers should start with pilot zone to correct the deviations timely as practice and conduct the policies step by step for the historical continuity of policies,so as to determine the effective results of policy implementation by law. Under the prospect of rural land management policy evolution,rural land management policy should be combined with rural revitalization,based on traditional farmers,combined with moderate scale management of rural land,and constantly optimize and adjust in the improvement of rural social governance.
