摘要
防控疫情是保障人民生命健康权的重要举措,但防控疫情所采取的一些必要措施又会对其他一些人权和公共利益的实现方式形成一定程度的限制。这种限制需要根据人权保障的要求予以一定的约束,使其不构成对基本人权的侵犯。从此次疫情防控过程来看,政府所采取的各项疫情防控措施如果忽视了对各项人权的协调保障,就有可能导致公众的不满情绪,甚至导致社会性的次生灾难。因此,从人权保障角度认真总结和吸取此次疫情防控工作中的经验和教训,对于完善应急管理的法律、制度、体制和机制具有深远的意义。
Epidemic prevention and control is an important measure to protect people's rights to life and health,but some necessary measures taken to prevent and control the epidemic will constitute restrictions on the realization of other human rights and public interests.Such restrictions need to be restricted according to the requirements of human rights protection,so that they do not constitute violations of basic human rights.A close Examining of the work process of preventing and controlling the Novel Coronavirus Pneumonia shows that,if the government's epidemic prevention and control measures ignore the coordination and protection of human rights,it may lead to public dissatisfaction,and even secondary social disasters.Therefore,from the perspective of human rights protection,it is of far-reaching significance to conscientiously summarize and draw lessons from the epidemic prevention and control work for the improvement of emergency management laws,systems and mechanisms.
