摘要
举报可以为打击腐败犯罪提供重要线索,依靠群众举报查处腐败犯罪一直是反腐败斗争的重要内容。然而我国关于举报人保护的规定分散且笼统,现有的举报人保护法制较为落后,存在诸多不足。立法的不完善导致打击报复反腐败举报人的事件频发,反腐败举报人的处境不容乐观。为充分保障举报人的合法权益,形成反腐倡廉的良好社会氛围,我国应借鉴其他国家对举报人保护的立法经验,制定一部专门性的举报人保护法律,总体上可以从举报人的权利、举报人保护机构及其职责、对举报人的特殊保护、保护举报人的程序和法律责任这五个方面进行考虑。
Whistle-blowing can provide important clues for combating corruption crimes.Relying on the masses to report and investigate corruption crimes has always been an important part of the fight against corruption.However,the existing legal system for the protection of whistleblowers in China is relatively backward,the provisions on the protection of whistleblowers are scattered and general,and the imperfect legislation leads to frequent vicious incidents of retaliation against anti-corruption whistleblowers,and the whistleblowers are faced with unfavorable situation.China should draw lessons from the legislative experience of other countries on the protection of whistleblowers,and formulate a specialized whistleblower protection act,so as to effectively protect the legal rights of whistleblowers,and form a good social atmosphere for anti-corruption.
