摘要
刑法学视野中法人犯罪理论的首要议题就是法人犯罪的归责原理问题。研究法人犯罪的归责原理,有必要从人格化社会系统责任论这一代表性理论中汲取有益经验。研究认为:该理论在建构、描述法人刑事责任与自然人刑事责任过程中存在着整体性悖论问题。这种整体性悖论是指解决法人的整体刑事责任问题要以认识自然人刑事责任为前提,解决自然人刑事责任问题又要以认识法人整体刑事责任为前提。整体性悖论问题须运用互补方法论予以克服。互补方法论在处理法人犯罪归责问题时,不仅同时考虑了自然人层面的要素与法人整体层面的要素,而且正确处理了这两个层面之间的相互关系。互补方法论对于建构具有中国特色的法人犯罪归责原理,具有普遍的启发意义。
The foremost topic of corporate crime theory in the perspective of criminal jurisprudence is the issue of corporate criminal liability.To investigate the corporate criminal liability,it is necessary to draw useful experience from the Responsibility Theory of Personalized Social System which is a representative theory in the field of corporate criminal responsibility.It is considered that the theory has a problem of holistic paradox in the process of constructing and describing the criminal responsibility of legal persons and the criminal responsibility of natural persons.This holistic paradox refers to that the solution to the criminal responsibility of legal persons must be based on the understanding of the criminal responsibility of natural persons and that the solution to the criminal responsibility of natural persons must be based on the understanding of the criminal responsibility of legal persons.The problem of holistic paradox must be overcome by using complementary methodology.In dealing with the issue of corporate criminal responsibility,the complementary methodology not only considers the elements both on the natural person’s level and the corporate holistic level,but also correctly handles the relationship between these two different levels.Complementary methodology has universal enlightenment for constructing the principles of corporate criminal liability with Chinese characteristics.
