摘要
互涉案件的调查工作是监察调查实务中存在的难点问题。由于监察法规定较为模糊,导致实践中对以监察机关为主调查的理解出现分歧,目前盛行的合并吸收模式就是这种理解分歧的产物。然而,合并吸收模式的法理正当性严重不足,采用该模式将造成法律适用上的混乱,使监察机关收集的部分证据的证据能力面临质疑。未来互涉案件的调查工作应当坚持以专案组模式为原则,以分别调(侦)查模式为例外。如果被调查人涉嫌的公安机关管辖的犯罪较为复杂,而且与职务犯罪关联性强,后续移交公安机关侦查有串供毁证、妨碍侦查之虞,则应当采取专案组模式,由监察机关牵头,吸收公安侦查人员加入,联合调(侦)查。如果被调查人涉嫌公安机关管辖的犯罪,与职务犯罪关联性不强,犯罪事实简单,容易查证,后续移交公安机关侦查并无毁证之虞,可以采取分别调(侦)查模式。
The investigation of cases involving each other is a difficult problem in the practice of supervisory investigation. Due to the vague regulation of Supervision Law, there are differences in the understanding of supervisory institutions that lead investigation in practice. The prevailing model of merger and absorption is the product of this diverse understanding. However, the legitimacy of the merger and absorption model is seriously insufficient. The adoption of this model will cause confusion in the application of law, and make the ability of some evidence collected by supervisory institutions to be questioned. In the future, the investigation of cases involving each other should adhere to the principle of special investigation team model, with the exception of separate investigation model. If the crime under the jurisdiction of the police institutions is complex and has a strong correlation with duty-related crimes, and subsequent transfer to the police for investigation is likely to result in collusion, destruction of evidence and obstruction of investigation, the special investigation team model should be adopted. Under this model, the supervisory institution takes the lead, and police investigators should be included in the joint investigation. If the suspected crime does not have a strong correlation with duty-related crime, the facts of the suspected crime are simple and easy to verify, and the subsequent transfer to the police for investigation is not likely to destroy the evidence, a separate investigation mode can be adopted.
