摘要
家政作为一个产业化进程缓慢的传统行业,在互联网技术的作用下激发了前所未有的活力,基于共享经济理念的互联网家政平台如雨后春笋般不断涌现。家政O2O模式对传统家政劳动关系带来了解构性冲击。本文采用案例研究方法,选取上海知名互联网家政企业“悦管家”作为研究对象,依据家政工人、用工家庭、家政机构和政府(行业协会)的四元分析框架发现:家政O2O模式下家政劳动突破服务对象为且仅为家庭的局限;不以劳动场所作为界定家政劳动的重要依据,家政工人队伍中的散兵游勇逐渐消亡;平台公司不再局限于“中介”身份而是承担类雇主的角色。为了促进劳动关系良性和谐运行,家政劳动关系可以通过伦理建构、法治建构和职业建构等途径重塑。
As a traditional industry with a slow industrialization process,domestic service has stimulated unprecedented vitality by Internet technology,and Internet platforms for domestic service have sprung up.Traditional domestic workers only provide services for the family,and have to enter the residence of the family members,in which the workers belong to the non-workers within the scope of labor law.This paper makes a case study of homemaking OTO from four aspects:domestic workers,families,domestic agencies and government.It is found that domestic labor breaks through the limitation of serving only the family,the working place is no longer an important factor in defining domestic workers,self-employment disappears,and platform companies are not limited to the status of"intermediary"but assume the role of quasi-employer.
