摘要
基于环境民事公益诉讼的预防性、环境污染评估的复杂性、环境保护的公益性,环境民事公益诉讼生效裁判文书的执行比其他类案件执行更具特殊性。构建专门化的环境民事公益诉讼执行程序的关键在于平衡审判中立与司法能动性、完善执行财产归属制度、建立三位一体的环境污染修复的事后监督机制、完善环境民事法律责任制度等。
Based on the preventive nature of environmental civil public interest litigation,the complexity of environmental pollution assessment,and the public interest nature of environmental protection,the enforcement of the effective judgment document of environmental civil public interest litigation is more special than that of other cases.The key to build a specialized enforcement procedure of environmental civil public interest litigation lies in balancing trial neutrality and judicial initiative,improving the system of property ownership,establishing a three in one post supervision mechanism for environmental pollution remediation,and improving the system of environmental civil liability.
