摘要
分类管理新形势下的民办学校选择登记工作正在推进,其中,补偿与奖励环节已成为各地方政府实施分类登记的关键。作为行政补偿与行政奖励的一个具体类型,民办学校选择登记中的补偿与奖励,目前还缺乏具体、系统的理论研究。实践中选择登记为非营利性民办学校的补偿与奖励范围、核算方法、程序、争议解决途径等也缺乏相应的法律法规作为依据。通过对各省级政府补偿与奖励规定的比较分析,尝试在新修订的《民促法》原则性规定的基础上,以行政补偿与奖励制度为设计依据,提出切实保护出资人合法权益、范围合理、程序规范、救济机制完善、核算方法可行的基本思路,全面深化我国民办学校选择登记中补偿与奖励制度,助力推进现有民办学校选择登记实施进程。
The selection and registration of private schools under the new situation of classified management is being promoted,among which the compensation and reward link has become the key implementation of classified registration by local governments.Compensation and rewards in the selection and registration of private schools,as a specific type of administrative compensation and administrative rewards,still lack systematic theoretical research.In practice,the scope,calculation methods,procedures,dispute resolution methods,etc.for non-profit private schools are also lack of corresponding laws and regulations as the basis.By comparative analysis of the compensation and reward provisions of the provincial governments,this paper attempts to take the administrative compensation and reward system as the design basis,on the basis of the principle provisions of the newly revised law of the People’s Republic of China on the promotion of the people,and puts forward the basic ideas of practically protecting the legitimate rights and interests of investors,reasonable scope,standardized procedures,perfect relief mechanism and feasible accounting methods,so as to comprehensively deepen the selection and registration of private schools in China medium compensation and reward system to promote the implementation process of selection and registration of existing private schools.
